ADT Residential Security System Litigation

Zimmerman Law Offices filed a nationwide class action lawsuit against ADT arising out of ADT’s alleged failure to disclose to residential customers the alleged vulnerability of its residential security systems to evasion and jamming of the system’s wireless peripheral sensors. Unbeknownst to ADT customers when entering into their residential monitoring contracts, their systems’ wireless peripheral sensors could be disabled with inexpensive equipment. The complaint alleges that ADT’s concealment of the security flaws was threatened in July 2014 when Logan Lamb, an employee at the Oak Ridge National Laboratories, planned to reveal publicly his findings about how ADT’s wireless sensors could be disabled.  The lawsuit sought money damages associated with the security systems’ lack of encryption.

Angel’s Envy Whiskey Litigation

Zimmerman Law Offices filed a class action lawsuit on behalf of a nationwide class of customers who purchased Angel’s Envy Rye Whiskey under the pretense that it was distilled in Kentucky. The whiskey is marketed as a small-batch Kentucky whiskey; however, the whiskey is actually distilled by an industrial manufacturer in Indiana using the same stock recipe as several other rye whiskeys. The lawsuit sought money damages for the customers who bought the whiskey at a premium price, and injunctive relief to change the whiskey’s labeling.

Aqua Illinois, Inc. Water Contamination Litigation

Aqua Illinois, Inc. owns and operates the public water system in the Village of University Park, Illinois. Aqua switched the source of the public water system and introduced a new chemical mix into the public water system which resulted in the removal of a protective layer in residential plumbing throughout the Village, causing lead to leach into the water delivered to Village residents. This contaminated the residential water of thousands of residents with lead resulting in a “do not consume” notice that warned all Village residents to not drink the water, and instead, the residents were instructed to drink and use bottled water. Zimmerman Law Offices filed a class action lawsuit on behalf of all Village residents seeking damages for the considerable aggravation, inconvenience and discomfort associated with the ongoing disruption to the residents’ day-to-day lives caused by the contamination and the risk of increased and irreversible health impacts, especially to young children, from drinking lead-tainted water. The lawsuit also seeks to recover financial damages, including recoupment of the residents’ payments for contaminated water, and the costs incurred to purchase bottled water and filters.

ARDMS Certification Examination Litigation

The American Registry for Diagnostic Medical Sonography (ARDMS), the body that administers examinations and awards credentials to professionals who utilize ultrasound technology, falsely reported that sonography professionals who took certification exams failed the tests when they had, in fact, passed. As a result of the false reporting of failing scores, sonography professionals across the country suffered harm to their professional reputation, lost their jobs, were denied employment opportunities, and had to sit for the certification exam a second time even though they had already passed the exam.  Zimmerman Law Offices filed a nationwide class action lawsuit seeking money damages to compensate for the job loss, demotions, and other negative consequences.

Arkansas Pandemic Unemployment Assistance Data Breach Litigation

As a result of the COVID-19 pandemic, a large number of self-employed Arkansans and “gig economy” workers were suddenly unemployed, necessitating the creation of the Pandemic Unemployment Assistance (“PUA”) program in Arkansas. The state hired Protech Solutions, Inc. to create a secure website through which unemployment benefit claimants could apply for PUA program assistance online. However, the personal and financial information of approximately 30,000 PUA claimants was exposed in a massive data breach that resulted in identity theft. Zimmerman Law Offices filed a class action lawsuit against Protech seeking compensation for the time these individuals will have to spend monitoring bank and credit card accounts, finding and remedying fraudulent charges, and repairing damage to their credit, as well as compensation for their identity theft and risk of future harm.

Bisphenol A, a chemical known as “BPA,” is used in the linings of plastic food and drink containers, but a report from the Department of Health and Human Services’ National Toxicology Program revealed a link between BPA and health and developmental problems in infants and children. Zimmerman Law Offices filed a nationwide class action lawsuit on behalf of customers who purchased baby bottles and sippy cups that contained BPA, seeking damages for the defective products and their personal injuries. The lawsuit alleged that manufacturers of the products knew that BPA could pose a serious health risk to infants and children, but nevertheless continued to use BPA in the products.

Chicago Athletic Clubs Rewards Program Litigation

Zimmerman Law Offices filed a class action lawsuit against the eight Chicago Athletic Clubs for abruptly terminating their members’ rewards program without advance notice, rendering the unused points that gym members had accrued useless. By performing certain activities, Club members earned rewards points that could be redeemed for gym merchandise, personal training sessions, massages, gym passes for friends, and other goods and services. However, after terminating the program, the Clubs refused to allow their members to redeem their accrued unused rewards points, and did not provide any other form of compensation to the members. The lawsuit sought to have the Clubs provide their members an opportunity to redeem their unused points, or provide money damages for the unused points that members had accrued.

Chicago Petroleum Coke Litigation

Several Chicago families filed a class action lawsuit contending that “petcoke”—a dangerous contaminant byproduct of the oil refinery process—has been consistently blowing onto their property and into their homes. For years, several companies stored the petcoke in uncovered piles out in the open, which caused clouds of black dust to blow into the surrounding community. Advertisers filed a class action lawsuit for fraud and for a violation of the Illinois Consumer Fraud Act arising out of the Chicago Sun-Times significantly overstating the circulation of its newspaper for several years. The overstatement enabled the newspaper to charge higher rates to advertisers. Zimmerman Law Offices filed a lawsuit against the City of Chicago after a person sustained a serious foot injury from falling into a hole in the sidewalk that was not repaired by the City. The City claimed that the injury was a result of the woman’s social activities that evening, which caused her movements to be unstable. However, her physician testified that the amount of alcohol present in her body that evening was not enough to impair her movements, and the City was held responsible for the injuries she sustained.

Comcast customers filed a class action lawsuit alleging that, even though Comcast advertised unfettered access to the internet, Comcast was restricting its customers’ peer-to-peer “P2P” service, resulting in slower internet connections. Cook County Sheriff Unconstitutional Search Litigation

Zimmerman Law Offices filed a class action lawsuit against the Sheriff of Cook County, Illinois, alleging that Sheriff’s deputies secretly monitor in real time and video record all pretrial detainees while they use the toilets in holding cells. There are solid partitions or dividing walls that separate the toilet area from the rest of the holding cell, such that the people retain an expectation of privacy when using the toilet. However, unbeknownst to the detainees, hidden cameras installed in the holding cells have an unobstructed view of the toilet and people’s naked bodies when they are using the toilet. The video feeds from the holding cell cameras are continually monitored by both male and female Sheriff’s deputies who monitor all pretrial detainees—regardless of whether they are male or female—in the holding cells, which constitutes an unconstitutional search and invasion of privacy. The lawsuit sought to halt this secret monitoring and compensate the pretrial detainees for their humiliation and embarrassment.

Coors Sweepstakes Fraud Litigation

MillerCoors began a sweepstakes wherein a special code was printed on its beer products. The code allowed consumers to enter the sweepstakes to win NFL football tickets. However, there were millions of invalid codes which did not allow consumers to enter the sweepstakes. Zimmerman Law Offices filed a nationwide class action lawsuit on behalf of beer purchasers who received an invalid code seeking an injunction to allow them to participate in the sweepstakes.

Country Club Hills Tax Rebate Litigation

Crestwood Red Light Camera Litigation

The Village of Crestwood, Illinois installed automatic traffic control cameras to record red light violations at the intersection of Cicero Avenue and Cal Sag Road. These cameras automatically issue citations to drivers who do not come to a complete stop before turning right on red. The lawsuit alleges that there is no red light controlling the right turn lanes at the intersection, and every red light camera ticket issued by the Village is void. Zimmerman Law Offices filed a class action lawsuit on behalf of all motorists who received red light camera citations at the intersection, to void over 56,000 red light camera tickets issued by the Village and obtain refunds of the $3 million in fines paid by the motorists.

CTA Fare Litigation

The Chicago Transit Authority (CTA) issued fare cards that its passengers must use in order to ride on CTA transportation. Passengers deposit money which is stored as a credit on the CTA fare cards. However, the fare cards automatically expired after an arbitrary time period, even if there was still a money credit on the card.  In such a case, the passengers would lose their money credit, as the CTA would not provide refunds. Zimmerman Law Offices filed a class action lawsuit on behalf of the CTA passengers seeking a full refund of the monies they paid and lost at the time their CTA fare cards expired.

CTA Train Crash Litigation

The driver of a Chicago Transit Authority (CTA) “brown line” train crashed into a CTA “purple line” train injuring multiple passengers on both trains. Although both trains were on the same track, an employee in the CTA “command center” erroneously gave the brown line train driver authorization to proceed. Zimmerman Law Offices filed a class action lawsuit on behalf of the CTA train passengers seeking compensation for their injuries.

DaimlerChrysler 15-Passenger Dodge Van Rollover Litigation

A van rollover crash killed two young boys and injured thirteen other passengers. East Chicago, IN Lead Contamination Litigation

Residents of the West Calumet Public Housing Complex filed a class action lawsuit against Atlantic Richfield Company, E. I. Du Pont de Nemours and Company, and The Chemours Company after government test results found that lead and arsenic levels in the soil at the housing complex were hundreds of times greater than what the Environmental Protection Agency (EPA) deemed safe for residential property. Plaintiffs sought reimbursement for past and future expenses related to the contamination, and monetary compensation for their injuries. Over 1,000 residents live in the West Calumet complex, more than half of whom are children.

The Spanish language directions for preparation and use on containers of Enfamil® Nutramigen® powder infant formula erroneously instructed consumers to mix twice as much formula with water than they should have. Equifax Data Breach

Zimmerman Law Offices, along with a consortium of law firms across the country, filed several class action lawsuits in various states against Equifax arising out of an enormous data breach that likely originated from a known web vulnerability which Equifax could have fixed months prior to the breach. Over 143 million people may have had their personal information exposed, leaving them vulnerable to identity theft for years to come. Equifax failed to alert consumers to the breach until almost six weeks after the breach had occurred. The lawsuits seek compensatory and punitive damages against Equifax, and injunctive relief to force Equifax to provide credit monitoring and identity theft protection to all of the affected consumers.

Excel Ambulance Fatal Crash Litigation

The day before Easter, an Excel Ambulance Service ambulance crashed into a building killing the driver and two passengers. Zimmerman Law Offices filed a wrongful death lawsuit against Excel Ambulance on behalf of the family of one of the passengers, seeking money damages for their loss. The ambulance driver had numerous felony convictions, and he previously lost his driver’s license after causing a traffic accident that resulted in serious injuries. The driver regained his license in 2013, but was required to obtain specialized “high-risk” insurance. The complaint alleged that the company should never have allowed an individual with a criminal background and reckless driving history to transport patients in an ambulance.

FACTA Credit Card Identity Theft Litigation

FACTA is a federal law that protects customers from identity theft by limiting credit and debit card information that can be printed on customer receipts. Zimmerman Law Offices has filed several class action lawsuits against retailers for disclosing customers’ credit and debit card information in violation of FACTA and their customers’ privacy rights. Hackers could use the disclosed credit and debit card information to engage in fraud and identity theft against the customers. A woman filed a lawsuit against the City of Naperville, certain members of the Naperville Police Department, and A&E Television Networks arising out of the Female Forces television program. First Suburban National Loan Interest Litigation

A class of First Suburban National Bank customers, represented by Zimmerman Law Offices, filed a class action lawsuit alleging that the bank overcharged customers inflated interest payments on their loans. The lawsuit alleged that a process by which the bank calculated interest on its loans, known as the “365/360 method,” caused borrowers to pay fraudulently inflated interest rates that were greater than the maximum rates allowed under Illinois law.

Ford Focus/Fiesta PowerShift Transmission Litigation

Zimmerman Law Offices filed a nationwide class action lawsuit against Ford Motor Co. on behalf of consumers who purchased 2011-2016 Ford Fiesta and 2012-2016 Ford Focus vehicles equipped with the PowerShift dual clutch transmission. The vehicles’ transmission experienced slipping, stuttering, premature internal wear, sudden acceleration, delay in downshifting, difficulty stopping, and other abnormal reactions. The complaint alleged Ford issued multiple Technical Service Bulletins (TSB) to dealers about the problems with the PowerShift transmission, but Ford actively concealed the transmission defects from its customers by telling them that the symptoms were “normal driving conditions”. The lawsuit sought money damages associated with transmission repairs and the decrease in the resale value of the vehicles.

Four Corners Restaurant Unpaid Wages Litigation

Zimmerman Law Offices filed a class action lawsuit on behalf of all bartenders and waitresses at all of the Four Corners restaurants in Chicago.  The complaint alleged a common scheme of underpayment of tips among all of the Four Corners restaurants, and the restaurants listed an amount of tips on the servers’ paystubs that was greater than the amount of tip money the servers actually received, which also caused the servers to pay income tax on money that was never given to them.  The lawsuit sought recovery of the unpaid compensation plus statutory damages.

Girard Speeding Ticket Litigation

The City of Girard, Ohio issued automated speed enforcement citations to drivers for traveling in excess of 55 m.p.h. on Interstate 80 when the speed limit was actually 65 m.p.h.  The “construction zone” speed limit was 55 m.p.h. while the highway was under construction.  After the construction work ended, the speed limit resumed to the posted 65 m.p.h. speed limit, but the automated speed cameras continued to issue speeding tickets to motorists travelling in excess of 55 m.p.h.  Zimmerman Law Offices filed a class action lawsuit against the City of Girard and the privately-operated company responsible for the installation and maintenance of the automated speed cameras to recover the money paid by motorists for the erroneously-issued speeding tickets.

Honest Company SLS Marketing and Sales Practices Litigation

The Honest Company advertises its mission to produce and sell products that are natural and free of harmful chemicals—specifically, free of sodium lauryl sulfate (SLS).  However, certain products such as Honest Laundry Detergent, Honest Dish Soap, and Honest Multi-Surface Cleaner contain sodium coco sulfate (SCS), a compound that The Honest Company claimed was a “gentler alternative” to chemicals such as SLS.  However, SCS contains a remarkable amount of SLS.  Zimmerman Law Offices filed a class action lawsuit on behalf of consumers who paid a premium for detergent, dish soap, and multi-surface cleaner marketed by The Honest Company as “Honestly Free of SLS.”  Plaintiffs sought recovery of money damages, and injunctive relief requiring The Honest Company to change its advertising.

Matterport Service Partner Litigation

Zimmerman Law Offices filed a class action lawsuit against Matterport, Inc. and its board members seeking monetary and injunctive relief on behalf of Matterport Service Partners (MSPs) for Matterport’s alleged misrepresentations and failures to comply with state disclosure requirements. The lawsuit alleges that Matterport made fraudulent misrepresentations to induce people to purchase expensive 3D cameras, become MSPs, and pay monthly fees to Matterport, and that Matterport also failed to comply with the business opportunity sales laws (BOSL) and seller assisted marketing laws (SAMP) of 22 states by failing to provide prospective purchasers with required disclosures. The lawsuit seeks to allow the MSPs to rescind their contracts, and obtain actual damages, and statutory damages, and also seeks an injunction to force Matterport to stop selling MSP plans until it complies with the BOSL and SAMP disclosure requirements.

Megabus Crash Litigation

Zimmerman Law Offices represented dozens of passengers in two separate lawsuits against Megabus arising out of two rollover bus crashes. Passengers in the first bus crash reported that the bus was having mechanical issues with its windshield wipers that did not work properly, and the bus driver was unable to clearly see the road in the rain. The bus driver in the second crash was driving too fast for the icy road conditions, which caused the driver to lose control. Zimmerman Law Offices filed a class action lawsuit against Monster, Inc. on behalf of consumers who purchased certain Monster HDMI cables with an advertised bandwidth of more than 10.2 Gbps. The lawsuit alleged that the statements on the HDMI cable packaging misrepresented that consumers are required to purchase and use Monster HDMI cables that transmit digital signals greater than 10.2 Gbps so that the consumers’ televisions function properly, but those representations were false because the increase in bandwidth does not affect the television’s performance. The lawsuit sought refunds of the purchase price for the HDMI cables, and injunctive relief to have Monster stop making these representations.

Natural Selection Foods E-Coli Spinach Litigation

After a nationwide outbreak of E. Coli from fresh spinach, Zimmerman Law Offices filed a nationwide class action lawsuit on behalf of restaurants that purchased contaminated spinach from Natural Selection Foods. It was discovered that a person secretly video recorded people while they were disrobing and using the tanning rooms. The lawsuit alleged that the gym failed to have adequate policies to prevent such breaches in security and privacy, and did not disclose to its members that there was a risk of being secretly video recorded, even after the gym discovered one of the cameras. Zimmerman Law Offices represented gym members whose privacy was violated, to obtain money damages for their severe emotional distress.

Pokemon GO Fest Litigation

Niantic, Inc., the creator of the Pokémon GO game, organized and promoted the Pokémon GO Fest in Chicago’s Grant Park, and 20,000 people from around the world traveled to Chicago to attend the fest. Niantic advertised that those in attendance would be able to play the Pokémon GO game with thousands of other players from around the world in one location, and that numerous special prizes, events, rewards, and exclusive “Legendary” Pokémon would be available only to those who were in attendance at the fest. However, technical and connectivity issues plagued the fest, due to overburdened cellular towers and Niantic’s own malfunctioning game server and software, rendering attendees unable to play the game. Zimmerman Law Offices filed a class action lawsuit on behalf of the attendees to recoup the travel and lodging expenses they incurred to travel to the fest.

The woman convinced people to pay her large sums of money and, in return, she would use her psychic powers to avert the tragic events from occurring. Zimmerman Law Offices filed a lawsuit against Warner-Lambert Co. on behalf of a woman whose son was born with several brain defects and disabilities. The lawsuit alleged that the company’s drug, Adrenalin, decreased the flow of oxygen to the fetus’s brain causing fetal anoxia, and the boy’s disabilities were a result of the mother being given Adrenalin to treat her asthma attack when she was seven months pregnant. Sonic Restaurants Data Breach

There was a data breach on the point-of-sale (“POS”) systems of several hundred Sonic Drive-In locations across the country that resulted in the unauthorized acquisition of their credit and debit card numbers. Zimmerman Law Offices filed a class action lawsuit against Sonic Corp. on behalf of customers who paid at a Sonic Drive-In restaurant using a credit or debit card. The lawsuit sought compensation for the time these individuals will have to spend monitoring bank and credit card accounts, finding and remedying fraudulent charges, and repairing damage to their credit, as well as compensation for their identity theft and risk of future harm. The lawsuit also sought to compel Sonic to make appropriate changes to its data security practices.

Surgery on the Wrong Knee Litigation

An orthopedic surgeon operated on the wrong knee of a patient who was undergoing ACL reconstruction surgery. The surgeon prepped and began performing surgery on the wrong knee, and after realizing his mistake he removed the surgical instruments and sutured the incisions. Sweetened Beverage Tax

The City of Chicago and Cook County, Illinois impose various taxes on sweetened beverages sold in their jurisdictions. Specifically, Chicago charges a 3% soft drink tax on the purchase of sweetened soft drinks sold in bottles, and Cook County imposes a tax of $0.01 per ounce on the purchase of all sweetened beverages. However, several retailers wrongfully imposed these taxes on purchases of unsweetened beverages. Zimmerman Law Offices filed multiple lawsuits against the retailers (including 7-Eleven, PepsiCo, Subway, and KFC) on behalf of consumers who were charged the tax on unsweetened beverages, to obtain refunds of the taxes and injunctions requiring the retailers to update their point of sale systems to properly assess the taxes in the future.

Unconstitutional Municipal Infrastructure Maintenance Fee Litigation

Zimmerman Law Offices filed a class action lawsuit against Illinois municipalities and telephone companies to seek a refund of a municipal telecommunications infrastructure fee that was added to Illinois residents’ monthly telephone bills. Airline passengers filed a class action lawsuit against United Airlines alleging that the airline purposefully chooses to leave behind passenger luggage in favor of cargo in order to meet aircraft weight limitations. The lawsuit alleged that, in order to increase profits, United will leave behind passenger luggage and prioritize more profitable cargo shipments. Under United’s policy, luggage that does not get transported on the same aircraft as the passenger does not receive a baggage fee refund, whereas United must refund the fee paid for cargo that does not get shipped as promised. Wonderful Pistachios Salmonella Litigation

An individual filed a class action lawsuit against Wonderful Pistachios & Almonds, LLC, The Wonderful Company, LLC, Paramount Farming Company, LLC, Wonderful Orchards, LLC, and Sam’s West, Inc. d/b/a Sam’s Club, after consuming Wonderful Pistachio raw pistachio nuts and subsequently falling ill. The Wonderful Pistachios are represented to be safely grown, safely processed and safe to consume; however, the Food and Drug Administration (FDA) and Center for Disease Control and Prevention (CDC) determined that an outbreak of Salmonella infections across the United States were caused by consuming Wonderful Pistachios that were contaminated with Salmonella. The class action lawsuit sought reimbursement for the price paid for the pistachios, and monetary damages associated with the illnesses.
